One important report that we regularly review is the IRS’s “From the Crime Desk,” which outlines developments in convictions and sentences for various tax crimes and enforcements in order to spread greater awareness.
What is the IRS Crime Desk?
The Internal Revenue Service (IRS) is responsible for collecting U.S. federal taxes as well as administering federal statutory tax laws. As such, the IRS frequently publishes Highlights From the Crime Desk, outlining developments in convictions and sentences imposed in federal criminal tax enforcement cases.
Criminal tax cases include personal and business tax evasion schemes, willfully subscribing to and filing false income tax returns, willful failure to file annual income tax returns, willful failure to pay income taxes, willful failure to pay over to the IRS payroll taxes that are withheld from employees’ wages, and attempts to interfere with the lawful functions of the Internal Revenue Service. In addition, other federal crimes can arise out of and/or be committed with the tax offenses that are also prosecuted involve money laundering and wire and mail frauds. Additionally, fraudulent tax preparers can be charged with willfully aiding and assisting in the filing of false income tax returns and aggravated identity theft.
Recent Findings in Highlights From the Crime Desk
In a recent addition of Highlights from the Crime Desk, the IRS identified the specific federal sentences imposed in eleven different criminal tax cases throughout the country. Of the cases reported, two involved convictions and sentencing for failing to pay over employment taxes. Specifically, a software developer was sentenced to 366 days in federal prison for failing to pay over-employment taxes. The total tax loss resulting from his failure to pay over the payroll taxes was $1,169,000. Similarly, a comptroller for a nonprofit in Puerto Rico was also sentenced to two years in federal prison related to her evasion of the payment of employed taxes owed by her employer.
What to Do If You Find Yourself In a Tax Predicament
The IRS’s criminal investigation division (CID) continues to investigate and recommend prosecution related to a Company’s failure to timely report and/or pay over-employment taxes for its employees. This is a high-priority enforcement initiative for the IRS. Yet, it is not the only one. If you and your company owe employment taxes or any other kind of taxes, you must take the matter very seriously and be proactive in working out a repayment plan for these liabilities.
